The National Company Law Appellate Tribunal (NCLAT) issued a directive on Monday, February 23, 2026, ordering the builder to transfer all maintenance responsibilities to the Apartment Owners Association (AOA). The tribunal has set a strict deadline of 30 days for this process, meaning the handover must be completed by March 25, 2026.

The court order covers a wide range of essential services that affect the daily lives of thousands of families living in these high-rise societies. According to the directive, Supertech must hand over the management of security, electricity supply, water systems, lifts, and common area maintenance. This decision comes after residents faced years of issues with substandard services.
A crucial part of this order involves the financial assets of the society. The builder is mandated to transfer the Interest-Free Maintenance Security (IFMS) funds, which were collected from residents, directly to the AOA bank accounts. The AOAs have already started internal audits of equipment like generators and fire safety systems to document their condition before the official takeover next month.
How does this impact the builder’s insolvency status?
Supertech Limited is currently undergoing the Corporate Insolvency Resolution Process (CIRP), and the builder had argued against the handover based on this status. However, the NCLAT dismissed these arguments. The tribunal clarified that insolvency proceedings do not give the builder a valid excuse to deny residents their statutory right to manage their own maintenance under the UP Apartment Act 2010.
