The Nandagram police in Ghaziabad have registered a case against the builder of MCC Signature Heights located in Rajnagar Extension. This action comes after a formal complaint was lodged by the Ghaziabad Development Authority (GDA). The builder, Annika Promoters, is accused of failing to hand over the society to the elected Apartment Owners Association (AOA) and withholding essential maintenance funds.
Why did GDA file a complaint?
According to the complaint filed by GDA Junior Engineer Imteyaz Ahmed Khan, the builder has refused to transfer the Interest Free Maintenance Security (IFMS) fund to the AOA. This fund is crucial for the upkeep of the society. Additionally, the Fire NOC for the building has expired, and the builder has reportedly not renewed it. This negligence regarding fire safety norms has raised serious concerns among the residents and authorities.
Builder ignored previous instructions
Officials revealed that the dispute has been ongoing for some time. Meetings were held on November 11 and December 8, presided over by the in-charge of the GDA AOA cell, to resolve the issue. During these meetings, the developer was clearly instructed to fix the deficiencies in the project and complete the handover process. However, the builder allegedly did not follow these directions, leading the authority to take legal action under the UP Apartment Act.
