The investigation into the tragic death of a 25-year-old biker in Janakpuri has led to stricter legal actions. A Delhi court has issued non-bailable warrants (NBWs) against two main contractors responsible for the sewer line project. The incident occurred last week when Kamal Dhyani fell into an open pit dug by the Delhi Jal Board. The police found major safety lapses at the site, which led to this fatal accident.
Who are the accused and what action is being taken?
The Delhi Police informed that warrants have been issued against Himanshu Gupta and Kavish Gupta. These two brothers are the contractors for the project where the accident took place. They are currently facing charges for their alleged negligence.
Apart from the contractors, the police have taken action against other staff involved:
- Rajesh Kumar Prajapati: The sub-contractor (47) was arrested earlier. A court has extended his police custody for one more day for further questioning.
- Yogesh: A labourer (23) who was present at the site has been sent to judicial custody for 14 days. He was arrested from Uttar Pradesh for failing to report the incident and misleading the family.
- DJB Officials: Three engineers from the Delhi Jal Board have been suspended for not monitoring the site properly.
What did the post-mortem report reveal?
The autopsy report released on February 10 gave clear details about how Kamal Dhyani died. Doctors stated the cause of death was traumatic asphyxia and suffocation. This happened because his face got stuck in wet soil inside the pit.
The heavy weight of the motorcycle on his chest also restricted his breathing, leading to death. The investigation highlighted that there were no warning signs, barricades, or lights at the 15-foot deep pit. The police have registered the case under Section 105 of the Bharatiya Nyaya Sanhita for culpable homicide.
